Terms of Service

Last updated: June 12, 2026

Welcome to XC Fly. These Terms of Service form a contract between you (User) and DAC Sistemas (DAC Sistemas Ltda., a private company registered in Brazil under CNPJ 24.594.223/0001-92), operator of the "XC Fly — Voo Livre" app, the website xcfly.com.br and the associated services.

1. Acceptance

By accessing or using the app, the website or any XC Fly service, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not use the service.

  • You must be at least 16 years old to use XC Fly. Minors between 16 and 18 need authorization from a legal guardian.
  • Continued use of the service after changes to these Terms implies acceptance of the new conditions (see section 13).

2. The service

XC Fly is a free flight-instrument app and social network for free-flight pilots — paragliding, paramotor, hang gliding and ultralight — operated by DAC Sistemas. It lets you use flight instruments (vario, altimeter, navigation), record flights (IGC/GPX files), track metrics, discover takeoff sites, plan group XC flights, broadcast your live position and interact with the global free-flight community.

The service is free for basic use and was built by pilots, for pilots. Additional features may be offered by subscription (see section 8 — Pro Plan).

3. Safety notice

4. Account and responsibilities

  • You must provide true, accurate and up-to-date information when registering.
  • Each person may have only one active account. Duplicate accounts may be removed.
  • You are responsible for keeping your credentials confidential and for all activity carried out on your account.
  • In case of unauthorized access, notify us immediately at suporte@xcfly.com.br.

5. Acceptable use

When using XC Fly, you agree not to:

  • Post false, misleading, defamatory, obscene, discriminatory, offensive or illegal content.
  • Use the platform for unauthorized commercial purposes (spam, unsolicited promotion, abusive marketing).
  • Attempt to access other users' accounts, private data or XC Fly's internal systems.
  • Reverse-engineer, decompile or attempt to extract the platform's source code.
  • Intentionally overload the infrastructure (DDoS, excessive scraping, abusive API usage).
  • Create fake accounts or impersonate another person or organization.
  • Publish third parties' information without proper consent (e.g. other pilots' flights or location without permission).
  • Violate aviation laws, DECEA/ANAC regulations or flight-safety rules when recording or reporting activities.

6. User content

6.1 Your ownership

You retain all rights to the content you publish on XC Fly — flights, photos, comments and profile data are yours. By publishing them, you grant us a non-exclusive, royalty-free, worldwide license to host, display, process and distribute that content within the service (feed, maps and other features), according to the visibility you choose for each item.

6.2 Visibility

You control the visibility of each flight (public/private) in the settings. Public content can be seen by other users and indexed by search engines.

6.3 Prohibited content and moderation

Illegal, offensive, discriminatory or spam content is prohibited. You are solely responsible for the content you publish. XC Fly does not endorse and is not responsible for user-generated content. Moderation may remove content that violates these Terms or the law, without prior notice.

6.4 Live tracking and group flights

When planning a group XC flight, you share the route and schedule with the invited pilots. When you enable live tracking, your real-time position is visible to other users while the broadcast is active; you can stop it at any time. Live tracking does not replace pilot-to-pilot communication, search-and-rescue services or flight plans filed with the authorities where applicable.

7. Flying sites and community information

Information about takeoff and landing sites (coordinates, wind directions, reviews) is provided by the community and is for information purposes only. XC Fly does not guarantee the accuracy, currency or safety of this information. Always check local conditions, consult certified instructors and follow safety rules before flying at any site.

8. Pro Plan

  • XC Fly Pro is an optional subscription that unlocks additional features in the app.
  • Billing is handled by the app store (Google Play or Apple App Store), under the store's terms and payment methods.
  • You can cancel at any time through the store's own tools (Google Play / App Store subscription management). Cancellation takes effect at the end of the period already paid.
  • Plan prices and features may change; changes do not affect periods already paid for.

9. Privacy

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms of Service.

10. XC Fly intellectual property

The source code, the XC Fly name, the logo, the design and the other original visual elements of the platform are owned by DAC Sistemas and may not be reproduced, redistributed or used without express authorization.

11. Service availability

XC Fly is provided "as is" and "as available", with no guarantee of uninterrupted availability — interruptions may occur for maintenance, updates or due to factors beyond our control. We reserve the right to modify, suspend or discontinue features at any time, with reasonable prior notice when possible.

12. Limitation of liability

To the maximum extent permitted by Brazilian law, XC Fly and DAC Sistemas shall not be liable for:

  • Damages arising from flight decisions made on the basis of information from the platform (see section 3 — Safety notice).
  • Indirect, incidental, special or consequential damages arising from the use of, or inability to use, the service.
  • Loss of flight data due to technical failure (we recommend keeping local copies of your IGC/GPX files).
  • Temporary or permanent unavailability of the service.
  • Content published by other users.
  • Failures of third-party services integrated with the platform.

13. Termination

  • You can delete your account at any time in the app (Settings → Account → Delete account) or as described on the page xcfly.com.br/en/delete-account.
  • We may suspend or terminate accounts that violate these Terms, harm other users or the integrity of the platform, or provide false registration information.
  • If your account is terminated for a violation, you may appeal through support within 15 days: suporte@xcfly.com.br.

14. Changes to the Terms

We may update these Terms of Service from time to time. Significant changes will be communicated by e-mail or by a prominent notice on the platform at least 15 days in advance. Continued use of XC Fly after the changes take effect implies agreement with the new Terms. The date of the last update is shown at the top of this page.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes arising from these Terms shall be resolved in the courts of the User's place of residence, in accordance with Brazilian consumer protection law (Consumer Defense Code — Law No. 8,078/1990).

16. General provisions

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
  • XC Fly's failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
  • These Terms constitute the entire agreement between you and XC Fly regarding the use of the service.
